About the whistleblowing channel law in Spain
The Whistleblowing Channel Law, also known as the Law on the Protection of Corruption Whistleblowers (Law 2/2023), establishes a series of provisions and regulations to ensure proper protection for people who report illicit or infringing actions within organisations, whether private companies or public bodies.
From what minimum number of employees is it mandatory to implement the reporting channel?
The minimum number is 50 employees.
Do I have to implement the reporting channel if my company has fewer than 50 employees?
For companies with fewer than 50 employees it is not compulsory, but it is recommended. For political parties, trade unions, business organisations and foundations that receive or manage public funds, it is compulsory regardless of the number of employees.
Which law requires it?
Law 2/2023 of 20 February, regulating the protection of persons who report regulatory infringements and the fight against corruption.
What happens if you do not have a reporting channel?
Each region will have its own oversight body. If the channel is not visible on the website, the infringement commission will impose fines ranging from €1,001 to €300,000 for natural persons, depending on the severity. For legal persons, fines will range from €100,000 to €1,000,000, depending on the infringement.

Is a public (external) portal mandatory?
According to Article 25 of Law 2/2023, a public access point must be available from the company’s website.
Do business groups that together exceed 50 employees require a reporting channel?
It is not obligatory, but it is recommended.
With regard to case management, does the law set deadlines and procedures?
Article 9 of Law 2/2023 states that an acknowledgement of receipt must be sent to the whistleblower within seven calendar days after receiving the communication, unless doing so endangers the confidentiality of the communication. The response period must not exceed 90 days in general; if a case is particularly complex, the response period may be extended by a further three months. How long does it take to implement the portal?
The implementation time may vary depending on factors such as company size and the degree of customisation of the solution. The technical configuration takes around one hour and does not require IT support from your company. Implementation will require you to input your internal policies and procedures. Most companies complete implementation within 1 to 15 working days, depending on complexity.
Can anonymous reports be made?
The platform allows whistleblowers to remain anonymous if the company permits this option. To guarantee anonymity, end‑to‑end encryption is used; metadata of uploaded files is removed and IP addresses are not tracked. For voice reports, the whistleblowers’ voices can be distorted to ensure anonymity.
